Hi All

well this subject has always been an issue for me. I am on the side that does not believe a living entity can be owned, like Nev and we are the ones who do this work and should be more interested than everyone else in it being implemented. Plant patent act was made for those multinational companies who make others dependent on their fertilizers and hormones etc...it is not a patent for intellectual property. So no one should have the right at owning a strain of any type of plant in my eyes. Imagine if someone could own food lines (like they are trying to do nowadays) would you not feel vulnerable in times of need if this were the case?

Think it out logically , seed was meant to be freely dispersed by the wind and insects and weather...so how could one even think to own something like that when it origins came from thousands of years of freedom? Humans look for ways to capitalise on free elements mother nature has been supplying freely for since time began. How arrogant we are to believe we have a right to now make it a business.

Be well Sb

there is a huge difference between plant breeder's act patenting (which is not really a patent in fact, europeen call it an other way) and intelectual patenting for living organisms.

Im not so sure about any real difference as far as i can see bonbolos the only way you can own rights to any plant or organism intellectual or other wise is if you your self create it from absolutely nothing.which is not the case here. to me its kinda like if you bought a cake mix and took it home mixed it up and baked it and put on some icing you made and told everyone you made the whole thing from scratch.:)

What I don't understand is that it seems that most people are against protection of a new variety.

What new variety?? all the varieties that are out are merely mixtures of natural varieties granted there is time and work involved in getting what you want out of said variety along with a whole lot of patience and skill
but i'm sorry simply breeding 2 plants together does not give you the right to place patents on things you didn't actually create you simply bred out natural traits that were already there they just needed some help being brought to the surface..Genetically altered plants or organisms are simply mans feeble attempts at playing GOD and trying to make something better that is already perfect without even understanding what it is they are doing. would be sorta like letting a monkey drive the space shuttle sure he can poke the buttons but does he know what they really do??
